Welcome to the SleepSpot onnline shop.

These Terms of Service apply when you access or use the SleepSpot online shop, purchase a product from us, create an account or otherwise interact with our online store.

The online shop is operated by SleepSpot Pty Ltd. By using the shop or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Returns and Refunds Policy and any other terms that apply to a particular product, promotion or service.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable Australian law.

Products

SleepSpot offers sleep-related products and other products that may be available through our online shop from time to time.

We make reasonable efforts to ensure product descriptions, photographs, prices and other information are accurate. Colours and appearance may vary slightly depending on your device or screen settings.

Products should be used in accordance with the instructions provided on the product or packaging.

Information provided on our shop, product pages or packaging is general information only and is not intended to replace individual medical or health advice.

If you have concerns about whether a product is appropriate for you, particularly if you have a medical condition, are pregnant or breastfeeding, take medication or have known sensitivities or allergies, you should seek advice from an appropriately qualified health professional.

Prices

All prices displayed on the SleepSpot online shop are in Australian dollars unless otherwise stated.

Prices may change from time to time. Any price change will not affect an order that has already been accepted.

Where applicable, prices include GST.

Shipping and delivery charges will be shown separately where applicable before you complete your purchase.

If an obvious pricing or product information error occurs, we may contact you before processing or dispatching your order. If we are unable to fulfil the order at the correct price, you may cancel the order and receive a full refund of any amount paid.

Orders

When you place an order, you are making an offer to purchase the products in your order.

You are responsible for ensuring the information you provide, including your delivery address, contact details and order details, is accurate.

You will generally receive an electronic confirmation after placing your order.

We may decline or cancel an order where reasonably necessary, including where:

a product is unavailable
there has been an obvious pricing or product information error
we are unable to process your payment
we reasonably suspect fraud or unauthorised activity
the delivery information provided is incomplete or invalid
we are unable to lawfully supply the product.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

Payment

Payment must be made using one of the payment methods available at checkout.

Payments may be processed by third-party payment providers. SleepSpot does not generally store your full credit or debit card details.

By providing payment information, you confirm that you are authorised to use the payment method provided.

Product Availability

Products are subject to availability.

We make reasonable efforts to keep stock information current, but occasionally a product may become unavailable after an order has been placed.

If we cannot supply an ordered product, we will contact you and provide an appropriate option, which may include a refund, replacement or another arrangement agreed with you.

Shipping and Delivery

We will make reasonable efforts to dispatch and deliver orders within the timeframes indicated on our website.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including postal or courier delays, severe weather, service disruptions or other events.

Please ensure your delivery address is accurate when placing your order.

If you realise you have provided incorrect delivery information, contact us as soon as possible at hello@sleepspot.com.au. We will try to assist, but we cannot guarantee that delivery details can be changed once an order has been processed or dispatched.

Any specific shipping terms displayed at checkout or in our Shipping Policy also apply to your order.

Returns, Refunds and Australian Consumer Law

SleepSpot does not offer returns, refunds or replacements for change of mind.

However, our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

If a product is faulty, damaged, incorrect or does not meet the consumer guarantees under Australian Consumer Law, you may be entitled to a remedy.

For a major problem, you may choose a refund or replacement. For a minor problem, we will provide an appropriate remedy within a reasonable time.

Nothing in these Terms limits your rights under Australian Consumer Law.

Accounts

If you create an account with the SleepSpot online shop, you are responsible for keeping your login details secure.

You are responsible for activity that occurs through your account where that activity results from your failure to keep your login information secure.

Please notify us promptly if you believe your account has been accessed without your permission.

We may suspend or restrict an account where reasonably necessary to protect the security of the account, our website, our customers or SleepSpot.

Intellectual Property

Unless otherwise stated, the content of the SleepSpot website and online shop, including text, photographs, graphics, logos, branding, product names, designs, videos and other materials, is owned by or licensed to SleepSpot Pty Ltd.

You may access and use the website and shop for your personal, non-commercial use.

You and SleepSpot submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have under applicable consumer protection laws regarding where a claim may be brought.
